Louisville Flat Fee MLS - Terms of Service

1Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of www.louisville-flat-fee-mls.com (the "Site"), operated by Louisville Flat Fee MLS ("we," "us," or "our"). By accessing or using the Site, submitting your information through any form on the Site, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms should be read together with our Privacy Policy, which explains how we collect, use, and share your information.

2Description of Service

Louisville Flat Fee MLS operates a marketing and referral platform that connects consumers interested in buying, selling, or renting real estate with independent, licensed real estate professionals ("Agents" or "Partners"). When you submit an inquiry through the Site, we may share your information with one or more Agents or brokerages, who may then contact you directly. We may receive compensation from Agents or brokerages for these referrals.

The Site does not list properties for sale on our own behalf, does not negotiate transactions, and does not provide any brokerage, legal, financial, or tax advice.

3Not a Brokerage

Louisville Flat Fee MLS is not a licensed real estate broker, brokerage, or agent in Kentucky or any other state. We do not represent buyers, sellers, landlords, or tenants in any real estate transaction, and no fiduciary, agency, or brokerage relationship is created between you and Louisville Flat Fee MLS by using the Site.

Any real estate services you receive are provided solely by the independent, licensed Agent or brokerage you are connected with, and that Agent or brokerage — not Louisville Flat Fee MLS — is responsible for the advice, representations, and services they provide to you.

4Eligibility

You must be at least 18 years old to use the Site or submit information through it. By using the Site, you represent that you meet this requirement and that any information you submit is accurate and belongs to you.

5Lead Submission and Consent to Contact

When you submit a form on the Site, you are requesting to be connected with one or more Agents or brokerages, and you authorize us to share the information you provide — including your name, phone number, email address, and property details — with those Agents or brokerages for that purpose.

You further consent to being contacted by Louisville Flat Fee MLS and/or the receiving Agent(s) or brokerage(s) by phone, text message, and email, including through automated dialing systems or pre-recorded messages, as described in our Privacy Policy. This consent is not a condition of using the Site.

You are responsible for ensuring the accuracy of the information you submit. Submitting false, misleading, or another person's information without authorization is prohibited.

6User Conduct

When using the Site, you agree not to:

• Submit false, fraudulent, or misleading information
• Submit another person's contact information without their consent
• Use automated means (bots, scrapers, or similar tools) to access or extract data from the Site
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems
• Use the Site for any unlawful purpose or in violation of any applicable local, state, or federal law
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to investigate and take appropriate action against anyone who violates this section, including removing content, suspending access, and reporting conduct to law enforcement where warranted.

7No Fees to Consumers

We do not charge consumers to use the Site or to be connected with an Agent. We are compensated by the Agents and brokerages who receive referrals, not by consumers. Any fees, commissions, or costs associated with an actual real estate transaction are governed entirely by the separate agreement between you and the Agent or brokerage you work with.

8No Guarantee of Accuracy

Property listings, market data, valuations, neighborhood information, and other content on the Site are provided for general informational purposes only. This information may be obtained from third-party sources, may not be current, and is not guaranteed to be accurate, complete, or error-free. You should independently verify any information before relying on it, including through your own inspection, appraisal, or professional advice.

9Intellectual Property

All text, graphics, logos, and other content on the Site, excluding third-party content and data licensed from others, is owned by Louisville Flat Fee MLS or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written permission, except for personal, non-commercial use.

10Third-Party Links and Partners

The Site may contain links to, or connect you with, third-party websites, Agents, brokerages, and service providers that we do not own or control. We are not responsible for the content, accuracy, privacy practices, or conduct of any third party, including any Agent or brokerage you are referred to. Your interactions with those third parties are solely between you and them, and any disputes arising from those interactions are not our responsibility.

11Disclaimer of Warranties

The site and all content, information, and services provided through it are offered "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any Agent or brokerage you are connected with will meet your expectations or needs.

12Limitation of Liability

To the fullest extent permitted by law, Louisville Flat Fee MLS and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site, your interactions with any agent or brokerage, or any real estate transaction, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the site shall not exceed one hundred dollars ($100).

Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13Indemnification

You agree to indemnify, defend, and hold harmless and its owners, officers, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, Agents, or Louisville Flat Fee MLS. You may stop using the Site at any time. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

15Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Oldham County, Kentucky, and you consent to the personal jurisdiction of those courts.

16Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.
